Terms and conditions for the provision of dance instruction services under the trade names "Czech Burlesque School" and "Zorya Blue" of the association Burlesque your life! z.s., with its registered office at Třebenická 22, Prague 8, 18200, ID no.: 21063559, L 78549/MSPH Municipal Court in Prague (hereinafter referred to as "Czech Burlesque School").
I. Basic provisions

These Terms and Conditions regulate the mutual rights and obligations related to dance instruction between the client and Czech Burlesque School. The client will find here:

A client of Czech Burlesque School is any natural or legal person who enters into a contract with Czech Burlesque School in one of the following ways:

by payment after submitting an electronic application on the website www.zoryablue.com/shop;

by payment after oral consent to registration given in person or via email to an administrative worker of Czech Burlesque School.
By entering into a contract in one of the ways listed in points a. to c. above, the client confirms that they have familiarized themselves with these Terms and Conditions and agree to them.

In the event that a client of Czech Burlesque School is not fully legally competent, legal actions for which the client is not capable due to their nature are carried out by their legal representative, or guardian.

For the purposes of these Terms and Conditions:

A course is a complete set of teaching hours organized by Czech Burlesque School, the duration of the course is specified by the number of lessons, a lesson is a teaching unit organized within a specific course, its duration is specified in minutes in the course offer.

A workshop is a single organized event, the duration of which is indicated in the workshop description.

A course participant is a client who has enrolled in one of the courses in the manner specified in Article I, paragraph 2, letters a. to c. of these Terms and Conditions, and has also paid the relevant course fee. A client and course participant is also a person who has authorized another person to conclude the contract in one of the ways a. and b. (e.g., a person who received the course as a gift).

The start of the course is the date of the first teaching lesson of the course published on the website with the course offer at www.zoryablue.com, or also in the lesson schedule sent by e-mail after registration.

If the contract between Czech Burlesque School and the client is concluded using means of distance communication, the client bears the full cost of using these means. The amount of these costs depends on the terms of the telecommunications service provider used by the client to conclude the contract. Czech Burlesque School does not charge any special fees for using means of distance communication.

The contract between Czech Burlesque School and the client is concluded for a definite period and will terminate upon the expiry of the last lesson of the respective course, or upon the completion of the respective lesson, or also before this time in the manners specified in these Terms and Conditions.

Given that the contract concluded between Czech Burlesque School and the client is a contract for the use of leisure time in the sense of § 1837 lit. j) of Act No. 89/2012 Coll., the Civil Code (hereinafter "Civil Code"), the client cannot withdraw from this contract even if it was concluded by distance communication or outside business premises.

Czech Burlesque School will send these Terms and Conditions in PDF format to the client via e-mail before payment, to the e-mail address provided by the client for this purpose when filling out the electronic application. In case of card payment, the documents may be delivered electronically to the client immediately after payment.

Czech Burlesque School stores concluded contracts and applications delivered in electronic form and keeps them for a period of three years from the expiry of the last lesson of the relevant course, or the end of the relevant lesson, unless legal regulations stipulate a longer retention period. Czech Burlesque School will allow the client access to the contract it concluded with the client, if such a contract was concluded in writing, if the client requests it in writing via e-mail sent to the address blue.zorya@gmail.com.

The individual technical steps leading to the conclusion of the contract are as follows:

The client chooses the course they want to attend, for which registration is possible given its capacity according to the current information provided on the website www.zoryablue.com or information communicated by phone or email by a Czech Burlesque School employee.

Further, the client fills in the data required in the application form (primarily their name, telephone and e-mail contact), reads the information about the course progress and the Terms and Conditions located next to the course schedule and application form. The client has the opportunity to familiarize themselves with the Terms and Conditions in advance on the website www.zoryablue.com.

By paying the course fee, a contract is concluded between the client and Czech Burlesque School.

Czech Burlesque School is not bound by any codes of conduct towards the client in the sense of Section 1826 (1) (e) of the Civil Code.

These Terms and Conditions are drawn up in Czech. The contract between Czech Burlesque School and the client can only be concluded in Czech.
II. Dates and location of classes and courses, attendance and make-up classes

Course dates organized by Czech Burlesque School are published on the website www.zoryablue.com in the table with the schedule and offer of current courses. The period from the conclusion of the contract between Czech Burlesque School and the client until the expiry of the last lesson within the given course is also the period for which the contract concluded between Czech Burlesque School and the client binds the contracting parties.

The day, time and place of the event, along with the date of the first lesson, and possibly a more detailed schedule of subsequent lessons, will be sent to the client approximately one week before the start of the course or workshop to the email address provided in the application.

Czech Burlesque School is entitled in exceptional cases to change the date and location of classes. Czech Burlesque School is obliged to inform the client of these changes without undue delay. A change in the date or location of a class does not constitute a reason for financial or other compensation from Czech Burlesque School.

Client's non-attendance at classes, including the client's individual stances on mandatory or preventive state measures (e.g., wearing respiratory protection), does not establish a right to compensation from Czech Burlesque School.

If the course is held in multiple parallel terms, Czech Burlesque School may offer the course participant the option of making up a lesson they could not attend. Registration for the course does not entitle the participant to a make-up lesson, Czech Burlesque School may regulate the number of make-up lessons provided and places for substitutes according to course capacity and other operational reasons.
III. Prescribed clothing and access to lessons, operational and safety rules of the halls

Entry to all dance halls where Czech Burlesque School holds its courses is permitted only in clean dance shoes or appropriate social footwear suitable for dancing.

Failure to comply with the prescribed clothing and footwear or other rules may be a reason for denial of admission to the lesson by Czech Burlesque School or an authorized person, or expulsion from the lesson.

It is forbidden to bring weapons, pyrotechnics, cans and other dangerous objects into the halls where Czech Burlesque School organizes its courses.

Persons under the influence of alcohol or intoxicating or addictive substances may be denied entry to a Czech Burlesque School lesson or may be expelled from the lesson in this state.

Clients are obliged to comply with the rules established by the owners and operators of the individual halls where Czech Burlesque School holds its courses, which are clearly displayed in the areas where these courses take place. Clients are obliged to respect the instructions of Czech Burlesque School and its authorized persons and employees of the Security and Fire Service and to follow these instructions.

Clients who were not admitted to a lesson, or were expelled from it during its course due to a breach of any of the above rules, are not entitled to a refund of the course fee or admission fee, and Czech Burlesque School is not obliged to provide them with any other form of compensation for the lesson to which they were not admitted or from which they were expelled.
IV. Making audiovisual recordings

Audiovisual recordings – primarily photographs and videos – may be made by Czech Burlesque School during lessons it organizes.

By concluding the contract specified in Article I, paragraph 2 of these Terms and Conditions, the client grants consent that audiovisual recordings depicting the client may subsequently be used, in particular, they may be displayed on the Czech Burlesque School's websites, Czech Burlesque School's social media pages, or used in other promotional materials of the Czech Burlesque School.

The client is not entitled to any remuneration or other compensation for the creation and use of such photographs and audiovisual recordings. This consent also applies to minor persons accompanied by the client.

Making audiovisual recordings of lessons by anyone other than the official photographer or videographer of Czech Burlesque School is allowed only with the consent of a Czech Burlesque School employee.

If Czech Burlesque School provides the client with educational materials (e.g., descriptions of dances and figures taught, video demonstrations of steps, etc.), the client undertakes to use these materials exclusively for their own needs and not to provide or make them accessible to third parties. In case of violation of this rule, Czech Burlesque School is entitled to exclude the client from the course without compensation. The right of Czech Burlesque School to compensation for damages caused by such action of the client is not affected.
V. Payment and cancellation policy

The current prices of individual courses are listed on the websites of Zorya Blue and Czech Burlesque School. Course prices include VAT. The costs of service delivery incurred by the client in connection with the use of the service (e.g., costs of transport to the course venue, parking fees, etc.) are borne by the client.

Czech Burlesque School accepts payments by credit card on the zoryablue.com website or by bank transfer.

The course fee or part of it can also be paid by entering the unique gift voucher code in the e-shop. The value of the gift voucher will be deducted from the course fee after entering the unique code. If the voucher has a higher value than the course fee, the client is entitled to use the remaining amount when purchasing another course on the website.

For each payment of the course fee, the Czech Burlesque School is obliged to issue a proof of receipt. In case of payment by bank transfer or credit card, the client will be sent an e-mail within 10 days of receiving the payment to the address provided in the application, confirming the payment's assignment to the application, along with a tax document.

If at least the minimum number of participants for a given course is not met, the Czech Burlesque School is entitled to cancel the course before its start. The minimum number of participants is individual for each type of course and is determined by the internal rules of the Czech Burlesque School. In the event of a course cancellation, the Czech Burlesque School undertakes to refund the full course fee to the participant by bank transfer within 7 days of the notification of cancellation. In such a case, the client is obliged to provide all necessary cooperation for the refund of the course fee, especially to immediately notify the Czech Burlesque School of the bank account number for the refund after the notification of course cancellation. If the course participant delays in providing the bank account number for the refund of the course fee, the refund period is extended by the duration of the participant's delay.

Registration for a regular course can be cancelled individually up to 7 calendar days before the start of the course or workshop via the email address blue.zorya@gmail.com. If the client cancels the registration more than 7 calendar days before the start of the first lesson of a regular course, the full amount paid for the course will be refunded. If the client cancels the registration for a regular course less than 7 calendar days before the start of the course, the full amount minus the fee for the first lesson will be refunded. The client can cancel the registration for a regular course within 24 hours after the end of the first lesson; in this case, the full amount minus the fee for the first lesson will be refunded. If the client cancels the registration later than 24 hours after the end of the first lesson of the course, the course fee is non-refundable.

Registration for a one-time course (workshop) can be cancelled up to 7 calendar days before the start of the course or workshop via the email address blue.zorya@gmail.com. If the registration is cancelled later, the course fee is non-refundable. Individual lessons are specifically regulated in Article V, paragraph 12 of the Terms and Conditions.

The cancellation date is understood as the date the cancellation email is delivered to blue.zorya@gmail.com.

The start of the course is understood as the date of the first teaching lesson of the course.

An exception to paragraph 11 of this Article of the Terms and Conditions may be granted only in cases of serious health reasons (e.g., illness preventing the completion of the entire course by the date of the last lesson, supported by a medical certificate). The granting of an exception under this paragraph depends on the assessment of the Czech Burlesque School, and the course participant is not entitled to it. In case of a positive assessment by the Czech Burlesque School and the granting of an exception, the Czech Burlesque School will transfer to the course participant by bank transfer to the bank account specified by the course participant in the cancellation form a proportional part of the course fee for lessons held after the interruption of their participation in the course, after deducting the amount of CZK 1,000, no later than 30 business days from the submission of all necessary documents (completion of the original cancellation form including the medical certificate section). The date of interruption of participation in the course is understood as the date of delivery of the cancellation email.

If for any reason a course participant is unable to attend or complete the course, they are entitled to find a substitute to attend the course in their place. The course participant is obliged to inform the Czech Burlesque School of the name and contact (registration) details of the substitute. It is not necessary to send a cancellation email. Upon assuming participation in the course, the substitute becomes a regular participant of the course with all rights and obligations under these Terms and Conditions, and by assuming participation, the substitute confirms that they have familiarized themselves with these Terms and Conditions and agree to them.

An agreed individual lesson with a Czech Burlesque School instructor or a bespoke workshop can be cancelled free of charge no later than 72 hours before its scheduled start. For cancellations 36 hours before the start, the cancellation fee is 50% of the lesson price; for cancellations less than 36 hours before the start, the entire lesson price is forfeited. Lesson cancellation must be done simultaneously in two ways: by SMS or phone call with the individual lesson instructor and by email to the Czech Burlesque School at blue.zorya@gmail.com. The cancellation of an individual lesson is effective from the later of these actions. The conditions for hall rental cancellation depend on the dance studio where the hall is located. Generally, cancellation with a refund is possible approximately 7 days before the start of the lesson.
VI. Liability for damages and rights from defective performance

The client is fully responsible for any damage caused by their conduct and actions to the Czech Burlesque School, other clients of the Czech Burlesque School, and third parties. In particular, they are responsible for damage caused to the equipment of the halls and their components. The client is obliged to immediately pay the full amount of any damage caused upon request by the Czech Burlesque School.

If the client does not pay the full amount of the damage, the Czech Burlesque School is entitled to prevent the client from attending lessons in all courses in which they are a participant, and to offset the course fees corresponding to lessons not yet attended against compensation for the damage. The right of the Czech Burlesque School to compensation for damages up to their full amount is not affected by this.

The Czech Burlesque School is not responsible for any injuries to the client (e.g., sprained ankle, broken limb, etc.) or damage to their clothing (e.g., torn dress, damaged shoes, etc.) that may arise in connection with the course curriculum.

Participation in dance competitions and games at Czech Burlesque School events is voluntary, and the client participates at their own risk.

Each participant is individually responsible for their own attendance and that of other course participants.

The Czech Burlesque School is obliged to provide services to the client without defects. With regard to extraordinary anti-epidemic measures in 2020 and thereafter, the client acknowledges that sports and cultural events are dependent on health circumstances and measures by state authorities and other institutions, and therefore, health, preventive, or organizational measures (such as respiratory protection, mandatory hand disinfection, confirmation of infection-free status with a negative test, vaccination certificate, or division of course participants into smaller groups) do not constitute defects. The client is obliged to report any defect in the service itself caused by the Czech Burlesque School without undue delay after they had the opportunity to discover the defect. A defect can be reported within six months from the date of the lesson during which the defective service was to be provided, in writing by letter sent to the registered office of the Czech Burlesque School or by email sent to blue.zorya@gmail.com or in person with a Czech Burlesque School instructor. If the client does not report the defect in time and the Czech Burlesque School objects to the late report, the court will not grant the client the right from defective performance.

During all operating hours, a staff member authorized to handle complaints is present at the Czech Burlesque School premises.

The Czech Burlesque School or its authorized employee will decide on a complaint immediately, or in complex cases, within 3 business days. This period does not include the time reasonably required for expert assessment of the defect, depending on the type of service. Complaints must be settled without undue delay, no later than 30 days from the date of filing the complaint, unless the Czech Burlesque School and the client agree on a longer period. The expiry of this period is considered a substantial breach of the contract.

If the service defect is remediable, the client may demand repair or completion of what is missing, or a reasonable discount. If the defect cannot be removed and the service cannot be properly used because of it, the client may either withdraw from the contract or demand a reasonable discount. The right from defective performance does not exclude the right to compensation for damages; however, what can be achieved by exercising the right from defective performance cannot be claimed under another legal ground. A client entitled to rights from defective performance is entitled to reimbursement of costs purposefully incurred in exercising these rights; the right to reimbursement must be exercised within one month after the expiry of the period for reporting the defect, otherwise the court will not grant the client the right if the Czech Burlesque School objects to the belated exercise of the right to reimbursement of costs.

After handling the complaint, the Czech Burlesque School will issue the client a written confirmation of the date and method of handling the complaint, or a written justification for rejecting the complaint.

Upon request, the Czech Burlesque School will issue the client a written confirmation of its obligations arising from defective performance to the extent prescribed by law.
VII. Processing of personal data

For the purpose of organizing courses and enabling clients to participate in these courses, the Czech Burlesque School processes clients' personal data to the extent necessary for unambiguous client identification. The collected personal data may also include any photographic records of the client taken on the course premises. The processing of client personal data is regulated in a separate document "Personal Data Protection," which is available on the Czech Burlesque School's website.
VIII. Final provisions

If any provision of these Terms and Conditions is or becomes invalid, it does not invalidate these Terms and Conditions as a whole.

These Terms and Conditions also bind any legal successors of the Czech Burlesque School or clients.

Unless a written agreement between the Czech Burlesque School and the client stipulates otherwise, these Terms and Conditions shall apply to all relations between the Czech Burlesque School and the client, unless they explicitly fall under other terms and conditions sent or handed over to the client (such as ticket events, vouchers). Issues not regulated by these Terms and Conditions are governed by the legal regulations of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code, and Act No. 634/1992 Coll., on consumer protection, as amended.

If a dispute arises between the Czech Burlesque School and the client that cannot be resolved by mutual agreement, the client may turn to the Czech Trade Inspection Authority as the competent authority for out-of-court settlement of consumer disputes on the Czech Trade Inspection Authority's website www.coi.cz or directly on the website for submitting a proposal to initiate out-of-court settlement of a consumer dispute http://adr.coi.cz/cs Consumers can also use the online dispute resolution platform established by the European Commission at http://ec.europa.eu/consumers/odr/. For judicial resolution of the dispute, one may turn to the competent court.

These Terms and Conditions are available at any time on the Czech Burlesque School website, and prospective clients have the opportunity to familiarize themselves with them well in advance of entering into a contract. Upon request, these Terms and Conditions and related documents are also available at the Czech Burlesque School office.

These Terms and Conditions are provided in a form that allows archiving and reproduction, and they can be stored and repeatedly viewed.

These Terms and Conditions come into force and effect on January 1, 2021, and are valid for courses and registered clients from this date onwards.
